Information from Alex Buchanan Dec 2000 & Glascott Symes (April 2001) TCD BA 1784 MA 1789 Chaplain & Secretary to HRH Edward, Duke of Kent, Rector of Kilmallog & Arklow There is a will copy dated 25 July 1819 1789 - James Symes coll V. Kilmallog and Lic Impr. C. Castle Ellis, Feb 25 (D.R). He was son of Richard S., of Ballyarthur, b in Co Wicklow, ed by Mr Dubourdieu, ent TCD July 8 1778 aged 17., BA 1784, MA 1789. He had been Preb. Fennor (Cashel) 1788-9 and had a chaplaincy in England while he held Castle Ellis. In 1802 he was cited before the Diocesan Consistorial Court for non-residence, and was deprived by the Bishop on Oct 28 1802, but appealed to the Metropolitical Court of Dublin, which decided against him. On appeal the Court of Delegates reversed that decision. Th Bp then petitioned the Privy Council on the ground that the sentence of the Court of Delegates was contrary to Ecclesiastical law, but his petition did not meet with success. Symes claimed that he had a lodging within the Union of Castle Ellis, in which he resided but not constantly because he had a residence elsewhere. Blakeney Ormsby, Parish Clerk and Charles Carter, a parishioner, testified that they knew of no residence of his in the parish. He held Castle Ellis till 1812 when he res. By his will, dated at Cheltenham, July 25 1819, he left all his property in Co.Wicklow and elsewhere (including Ballyarthur) to his nephew, Rev Edward Bayly of Lamberton, Co.Wicklow, £1000 to Rev Edward Bayly of Killoran, Co Wexford and £500 to the latter's elder daughter, Lucinda, £50 a year to Lt-Col Charles Hardy of Waterford and £30 a year Mrs Eliz Coates of Ballybeg, and a set of "the New Cyclopedia" to Thomas Weever of Gloucester; witnesses, John Carroll, Mary Hewett and Thomas Minster, Surgeon.
